1. Interpretation and Definitions
Interpretation. Words with initial capital letters have meanings defined below. These definitions apply whether in singular or plural.
Definitions.
Company, we, us, our: Phoenix Breathwork Method.
Website: https://phoenixbreathworkmethod.com and any pages or checkouts we operate.
Service: The Website, in-person events (including Phoenix Fire Night), in-person trainings and workshops, and online courses or digital products.
Event: Any in-person experience run by us, including Phoenix Fire Night, in-person trainings and workshops.
Course: Any online course, program, digital manual, or streaming content sold by us.
You: The individual or entity accessing or using the Service.
2. Acknowledgment
These Terms & Conditions (“Terms”) govern your use of the Service and form a binding agreement between you and the Company. By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. You represent that you are at least 18 years old.
3. Health, Safety & Eligibility
Breathwork and related practices may involve physical, emotional, and energetic release. You are solely responsible for assessing your readiness. Participation is not advised for individuals with certain conditions (e.g., severe asthma, cardiovascular disease, epilepsy/seizures, late-stage pregnancy without medical approval, recent surgery, or severe mental health conditions). Always consult a qualified healthcare provider. Our facilitators do not provide medical advice, diagnosis, or treatment. In cases of doubt, do not participate.
4. Tickets, Enrolments & Access
Your purchase grants you a revocable license to attend an Event or access a Course as described at checkout. We reserve the right to refuse entry or remove any participant for safety, disruption, or breach of these Terms, without liability beyond what these Terms allow.
5. Prices, Payments & Taxes
Prices are shown at checkout and may change at any time prior to purchase. You authorize us and our payment processors to charge your selected payment method. You are responsible for any applicable taxes, currency conversion fees, or bank charges. If an installment plan is offered, you must complete all installments; failure to pay may result in suspension of access.
6. Refunds & Cancellations
6.1 In-Person Events & Trainings (including Phoenix Fire Night)
All sales are final. No refunds under any circumstances.
Transfers permitted: You may transfer your ticket/attendance to another person by emailing [email protected] at least 24 hours before the scheduled start. Include:
Your full name and order reference;
New attendee’s full name, email, and phone number.
Transfers are subject to reasonable verification and administrative processing. Name changes requested within 24 hours of the start time may be declined.
6.2 Online Courses & Digital Products
All sales are final. No refunds or cancellations.
Our Courses and digital materials are digital products. By purchasing and/or accessing any digital content, you request immediate delivery and acknowledge that access begins right away. You expressly consent to this and waive any statutory cooling-off/withdrawal rights that would otherwise apply to digital content once delivery begins. Do not purchase if you do not agree.

7. Schedule Changes, Postponements & Force Majeure
We may modify Event schedules, venues, facilitators, or formats when reasonably necessary (e.g., illness, venue issues, regulatory guidance). If an Event is postponed or materially changed, we will offer a reasonable alternative date/credit. We are not responsible for travel, accommodation, or other consequential costs. We are not liable for delays or failures caused by events beyond our reasonable control (including but not limited to acts of God, strikes, epidemics, government restrictions, or power/network outages).
8. Conduct & Community Standards
You agree to participate respectfully and follow facilitator instructions. We may remove any attendee who appears impaired, disruptive, unsafe, or disrespectful. Illegal substances are prohibited. You are responsible for your personal belongings.
9. Content Ownership & License
All materials we provide (manuals, videos, audio, curricula, brand assets, slides) are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license for personal use only. You may not copy, distribute, record, rebroadcast, publish, resell, or create derivative works without prior written consent.
10. Photography, Audio & Video
We may capture photos/audio/video during Events for documentation and marketing. By attending, you grant us a royalty-free, worldwide license to use your likeness in such media in connection with the Service. If you prefer not to be recorded, notify staff on arrival; we will use reasonable efforts to accommodate.
11. Third-Party Links & Services
The Service may contain links to third-party websites or tools. We do not control and are not responsible for their content, policies, or practices. Use at your own risk.
12. “AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13. Limitation of Liability
To the maximum extent permitted by law, the Company and its facilitators, employees, contractors, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service or participation in any Event/Course. Our total aggregate liability for any claim shall not exceed the amount you paid to us for the specific Event or Course giving rise to the claim.
14. Indemnification
You agree to indemnify and hold the Company harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or your participation in the Service.
15. Privacy
Our collection and use of personal data are described in our Privacy Policy, which forms part of these Terms.
16. Governing Law; Consumer Rights
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. If you are a consumer resident in another country, you may benefit from any mandatory consumer protections of your place of residence. Any dispute shall first be raised with us informally at [email protected].
17. Severability & Waiver
If any provision is found invalid or unenforceable, the remaining provisions remain in effect. No waiver of any term is a continuing waiver of that term or any other term.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date and, where appropriate, reasonable notice. Continued use of the Service after changes become effective constitutes acceptance.
